1. Acceptance of Terms & Merchant Identity
These Terms of Service ("Terms") govern all sales, quotes, and deliveries made by Australia Shipping Container Stands (ABN 18 637 745 290, ACN 637 745 290) ("we", "us", "our"), operating from 17 Kleinhans Ct, Lowood QLD 4311, Australia. By placing an order through our website, by email, or by phone, you ("the customer") agree to be bound by these Terms. If you do not agree, do not proceed with a purchase.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded.
2. Product Descriptions & Condition Grading
We sell new and used shipping containers, modified units, and portable buildings. Container conditions are graded as follows:

| One-Trip (New) | Manufactured overseas and shipped to Australia with a single cargo load. Near-new condition; minor handling marks may be present from transport. |
| Cargo Worthy (Used) | Structurally sound and certified suitable for cargo transport. Wind and watertight, with cosmetic wear consistent with shipping service (dents, surface rust, faded paint). |
| Wind & Watertight (Used) | Sealed against wind and water ingress and suitable for storage. Cosmetic wear, dents, and surface rust are expected and do not constitute defects. |
| As-Is | Sold in current condition without warranty as to wind or water tightness. Suitable for parts, projects, or non-critical storage. Inspection before purchase is recommended. |
Photographs on product listings are representative of the grade unless the listing states that photos show the exact unit. Used containers will show cosmetic variation between units of the same grade; cosmetic wear consistent with the stated grade is not a defect. Where a specific unit reference number is listed, the description and photos relate to that unit.
3. Quotes, Pricing & Payment Terms
- All prices are in Australian dollars and include GST unless stated otherwise.
- Written quotes are valid for 14 days unless otherwise stated.
- Accepted payment method: direct bank transfer (EFT) only. Bank account details are provided on your invoice or order confirmation. We do not accept card payments, cash, or cheques.
- Standard orders require payment in full prior to dispatch. Goods remain our property until payment has been received in full (retention of title).
- Custom, modified, and contract builds may be structured on a 40/40/20 payment plan (40% deposit to commence, 40% progress payment, 20% balance prior to delivery), as set out in the applicable sales contract.
- Deposits on custom or modified builds cover materials and fabrication commenced on your behalf and are non-refundable once fabrication has begun, except where required by the ACL.
4. Delivery, Site Access & Risk
- Delivery is performed by tilt-tray or side-loader truck in accordance with our Shipping & Delivery Policy.
- The customer is responsible for ensuring the delivery site is safe and accessible: minimum 6 metres of overhead clearance, firm level ground, and adequate truck access and turning room.
- If delivery cannot be completed because the site is inaccessible, unsafe, or no authorised person is present as arranged, a failed delivery fee (equal to the actual freight cost incurred) plus a redelivery fee will apply before a second attempt is booked.
- If the customer redirects delivery to a different address after dispatch, additional freight charges will be quoted and payable before redirection.
- Our driver may decline placement that is unsafe or would damage property or equipment. In that case, the unit will be placed in the nearest safe position or returned to depot at the customer's cost.
- Risk in the goods passes to the customer upon delivery (or upon collection from our depot). Title passes upon receipt of full payment.
- Any placement directions given by the customer or their representative at delivery are followed at the customer's risk. We are not responsible for underground services, driveways, septic systems, or other site features not disclosed to us in writing before delivery.
5. Inspection on Delivery
The customer (or their authorised representative) should inspect the unit at delivery and note any transport damage on the delivery documentation. Any claim relating to damage in transit or an incorrect unit being supplied should be reported to us within 7 days of delivery, with photos, in accordance with our Refund & Return Policy. This reporting period does not limit your rights under the ACL.
6. Australian Consumer Law & Limitation of Liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Subject to the ACL and to the maximum extent permitted by law:
- Cosmetic wear consistent with a unit's stated condition grade (including dents, surface rust, and faded paint on used units) does not constitute a failure to meet a consumer guarantee.
- Our liability for any claim is limited, at our election, to the replacement of the goods, the supply of equivalent goods, the repair of the goods, or the payment of the cost of any of these.
- We are not liable for indirect or consequential loss, including loss of profit, business interruption, or costs arising from delivery delays outside our reasonable control.
- Where goods are acquired for business purposes and are not of a kind ordinarily acquired for personal, domestic, or household use, statutory guarantees apply only to the extent required by law.
7. Council Approvals & Intended Use
The customer is solely responsible for obtaining any council, planning, or building approvals required for the placement or use of a container or portable building on their property. We recommend confirming local requirements with your council before ordering.
8. Cancellations
Orders for in-stock standard units may be cancelled prior to dispatch; a refund will be processed less any payment processing or freight booking costs already incurred. Orders for custom or modified builds may only be cancelled in accordance with the applicable sales contract, and deposits are treated as set out in clause 3. Nothing in this clause limits your ACL rights.
9. General
- These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- We may update these Terms from time to time. The version published on our website at the time of your order applies to that order.
